Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and Resolova Software ("we", "us", "our"), the developer of the Alarmingo mobile application ("App").

Access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the App.

Subject to your compliance with these Terms, Resolova Software grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a personal device that you own or control, solely for your personal, non-commercial purposes.

Under this licence you may:

• Download and use the App on your personal device
• Access all free features provided within the App
• Access premium features during an active paid subscription period
• Participate in tournaments and community features

This licence does not include any right to sublicense, sell, resell, transfer, assign or otherwise exploit the App or any content within it.

Certain features of the App may require you to create an account. You are responsible for:

• Providing accurate and up-to-date information when creating your account
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

You agree not to engage in any of the following activities:

• Reverse engineering, decompiling or disassembling the App or attempting to extract its source code
• Manipulating or exploiting the tournament system, streak counters, scores or any other in-app metrics
• Using automated tools, bots, scripts or other means to interact with the App in a non-human manner
• Copying, distributing, reproducing or creating derivative works of the App or its content
• Using the App for any commercial purpose without our prior written consent
• Attempting to gain unauthorised access to our systems or another user's account
• Uploading or transmitting viruses or any other malicious code
• Violating any applicable laws or regulations in connection with your use of the App

Alarmingo is available in two tiers: a free tier and a premium (Pro) subscription. The premium subscription unlocks additional features and removes limitations on the free tier.

• Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date
• Cancellation must be completed through your device's App Store or Google Play settings
• No refunds are provided for unused portions of a subscription period, except where required by applicable law or platform policies
• Prices may vary by region and are displayed in your local currency at the point of purchase
• We reserve the right to change subscription pricing with reasonable advance notice

Alarmingo hosts periodic tournaments in which users compete for prizes based on their in-app performance scores. Participation in tournaments is subject to the following conditions:

• Tournament eligibility, rules and scoring formulas are defined within the App and may change between seasons
• Prizes are awarded at Resolova Software's discretion and may be modified or withdrawn at any time
• Prize winners will be contacted through the App or via the email associated with their account
• Prizes may be subject to applicable taxes and legal requirements in the winner's jurisdiction

The App and all of its contents — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are the exclusive property of Resolova Software or its licensors and are protected by applicable intellectual property laws.

The "Alarmingo" name, logo and mascot are trademarks of Resolova Software. You may not use these marks without our prior written permission.

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Resolova Software disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose and non-infringement
• That the App will be uninterrupted, error-free or free of viruses or other harmful components
• That defects in the App will be corrected
• The accuracy, reliability or completeness of any content within the App

Language learning outcomes vary by individual. We do not guarantee any specific educational result from use of the App.

To the maximum extent permitted by applicable law, Resolova Software and its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to:

• Loss of data, including learning progress, streak data or tournament scores
• Loss of revenue or profit
• Service interruptions or App unavailability
• Any damages arising from your reliance on information provided within the App

Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or €50, whichever is greater.

We may suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us or third parties, or for any other reason.

You may stop using the App at any time. To delete your account and associated data, please contact us at hello@resolova.com.

Upon termination, all licences granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers and limitations of liability.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification within the App.

Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App.
